Introduction
Welcome to Doux HR Solutions. These Terms and Conditions govern your access to and use of our recruitment services. By engaging with our Services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
Definitions
"Company" refers to Doux HR Solutions, the provider of the recruitment services.
"Client"refers to any individual or organization using the Company’s recruitment services.
"Candidate"refers to any individual introduced to the Client by the Company for recruitment purposes.
Services Provided
Doux HR Solutions provides recruitment services across various industries including but not limited to IT Services & Consulting, Healthcare, Pharmaceuticals, Automobile, Automation, Manufacturing, Education, and FMCG. The Company endeavors to match candidates with the Client's requirements based on the qualifications, experience, and skills provided.
Client Obligations
- The Client agrees to provide accurate and complete information regarding job vacancies, candidate specifications, and any other relevant details that may affect the recruitment process.
- The Client shall notify the Company of any engagement (permanent or temporary) of a candidate within 10 working days of employment.
- The Client agrees to pay the service fees as specified in the invoice within the agreed payment terms.
Candidate Representation
- Doux HR Solutions endeavors to ensure the accuracy of the information provided by candidates. However, the Company does not guarantee the accuracy, authenticity, or completeness of the information provided by the candidates.
- The Company shall not be responsible for any loss, liability, or damage suffered by the Client as a result of any inaccuracies in the information provided by the candidates.
Fees and Payment Terms
- The Client agrees to pay the recruitment fees as set out in the proposal or service agreement.
- All invoices are payable as set out in the proposal or service agreement.
Candidate Engagement
- If a Client hires a candidate introduced by Doux HR Solutions within 6 months of the initial introduction, the recruitment fee shall apply.
- If a candidate leaves employment as set out in the proposal or service agreement, the Company agrees to provide a replacement at no extra charge, provided all fees have been paid as agreed. This does not apply if the candidate was made redundant or the job role was terminated by the Client.
Confidentiality
Both parties agree to keep confidential all information relating to candidates, business practices, and the recruitment process. Neither party shall disclose any such information to a third party without prior written consent.
Limitation of Liability
- Doux HR Solutions is not liable for any indirect or consequential loss or damage arising from the recruitment services provided.
- The total liability of the Company for any claim related to the services shall not exceed the fees paid by the Client to the Company for the recruitment services in question.
Termination
- Either party may terminate the agreement by giving [insert notice period] written notice.
- In the event of termination, the Client agrees to pay for all services rendered up to the date of termination.
Dispute Resolution
Any dispute arising out of or in connection with these Terms and Conditions shall be resolved amicably between the parties. If an amicable resolution is not possible, the dispute shall be referred to arbitration in accordance with the rules of the Gurgaon Arbitration Centre.
